South Sudanese President Salva Kiir and his bitter rival and former vice president Riek Machar, now leader of the SPLM-IO rebels, met in the Sudanese capital Khartoum June 27 to sign a "permanent" ceasefire agreement, pledging to form an inclusive transitional government. The parties agreed to open humanitarian corridors, release detainees, withdraw troops and militarily disengage. The agreement calls on the African Union and the regional bloc IGAD to deploy protection forces and monitors to observe the ceasefire implementation. The transitional government is to form a national army and security forces not linked to tribalism, and to collect weapons from the populace. The parties also agreed to immediately start work to resume oil production at sites in Unity state (Blocks 1,2 and 4) and Tharjiath (Block 5), which have for years been paralyzed by the conflict.
The ACLU of Southern California on March 12 filed a lawsuit (PDF) in federal court on behalf of several immigrants with Temporary Protected Status (TPS) and citizens whose parents have TPS, challenging the Trump administration's revocation of the status for over 200,000 people. The Trump administration has terminated TPS for all people from El Salvador, Haiti, Nicaragua and Sudan. The suit contends that the Trump administration's interpretation of the TPS statute is unconstitutional as it interferes with the right of school-aged citizen children of TPS beneficiaries to reside in the country. The young citizens would have to choose whether to leave the country or to remain without their parents.
Protests against austerity and the lords of capital are erupting simultaneously in Iran, Tunisia, Sudan, Morocco, China, Peru, Honduras, Argentina and Ecuador, recalling the international protest wave of 2011. Such moments open windows of utopian possibility, but those windows inevitably seem to close as protest movements are manipulated by Great Power intrigues or derailed into ethnic or sectarian scapegoating. Sudanese authorities on Jan. 7 carried out mass arrests and confiscated newspapers as protests exploded over rising bread prices and severe economic austerity. One student was killed amid demonstrations in Geneina, capital of West Darfur state. Protests were also reported from the cities of Nyala, South Darfur; al-Damazin, Blue Nile atate; and the capital Khartoum. The unrest broke out as bakeries doubled the price of bread following a government decision to increase the price of flour nearly fourfold. The decision was part of a package of austerity measures issued by the Sudanese government under the country's 2018 budget, seeking to address the spiralling inflation rate, currently at about 25%.
The International Criminal Court (ICC) ruled (PDF) July 6 that South Africa violated its treaty obligations by failing to arrest Sudanese President Omar al-Bashir when he visited the country in 2015. Two arrest warrants (PDF, PDF) have been issued for al-Bashir involving numerous charges including "crimes against humanity, war crimes, and crimes of genocide." South Africa contended that because al-Bashir has immunity from criminal proceedings under customary international law that had not been waived in Sudan, the court was precluded from compelling South Africa to detain and surrender him.
Two federal judges—one in Maryland on March 16 and another in Hawaii the day before—issued temporary restraining orders (PDF, PDF) against President Donald Trump's new 90-day travel ban. Finding that the state had established a strong likelihood of success on the merits, Hawaii District Judge Derrick Watson issued an opinion permitting continued travel from six predominantly Muslim countries listed on Trump's order. Trump responded to the order, calling it "the bad, sad news," and "an unprecedented judicial overreach." The new order, which dropped Iraq from the banned countries list, would have barred entry for nationals from Iran, Libya, Somalia, Sudan, Syria and Yemen for 90 days, and completely banned entry of refugees for 120 days.
Politicians wielding a dehumanizing rhetoric are creating a more divided and dangerous world, warned Amnesty International as it launched its annual assessment of human rights around the world. The report, "The State of the World's Human Rights" (PDF), warns that the consequences of "us vs them" rhetoric setting the agenda in Europe, the United States and elsewhere is fuelling a global pushback against human rights and leaving the global response to mass atrocities perilously weak. "President Trump's policies have brought the US to a level of human rights crisis that we haven't seen in years," said Margaret Huang, executive director of Amnesty International USA. "As the world braces itself for a new executive order, thousands of people inside and outside of US borders have had their lives thrown into chaos as a result of the president's travel ban. This administration, like other governments across the world, is playing politics with people's lives. President Trump and leaders across the globe should be reaffirming and upholding international human rights protections, not exploiting fear and prejudice for their own agendas."
Leaders of multiple African countries announced Feb. 1 that they have backed a "strategy of collective withdrawal" from the International Criminal Court (ICC). Prior to this week's African Union (AU) summit, the AU issued a document seen by Reuters that proposed a coordinated withdrawal unless the ICC is reformed. The AU claims that the ICC is improperly focusing on prosecuting individuals from African countries, and its exit could be significant, as almost a third of the ICC's member countries are African. The AU and the ICC have had a tumultuous relationship over the course of the past year. In July an AU advisory board accused the ICC of narrowly focusing its investigations on African government leaders since its inception in 2002. The AU's Economic Social and Cultural Council (ECOSOCC) recommended that members quit the ICC should Rome Statute signatories follow through with a proposed amendment allowing the prosecution and arrest of sitting heads of state. Human Rights Watch stated that giving sitting leaders immunity would defeat the purpose of the ICC's creation.
